POLICE rearrested a man the court previously dismissed defilement charges against and recharged him with indecent assault.

Peter Hoka, who was released last week after a preliminary inquiry into the defilement charges found insufficient evidence, now faces five counts of indecent assault.

These were over the same incident he allegedly committed between March 1 and March 31 on Gela in the Central Province.

Prosecutor Natalie Kesaka told the court that the accused has already spent time in custody for the defilement charges and has co-operated with Police.

“He was charged and brought before the court.”

For these reasons the Prosecution did not want to remand him but asked the court if he could be bailed to appear on the next occasion.

Ms Kesaka applied for the accused to be released on a cash bail of $500 with strict conditions given by the court.

He is to remain in Honiara, he is to report to Henderson Police Post once a week, and not interfere with Police witnesses.

The court also ordered that the accused be remanded in custody until he pays the cash bail of $500.

The accused was unable to pay the cash bail yesterday and was remanded in custody.

He appears again January 28.
