Jimmy Lusibaea: Released after only spending 45 days of his two years and nine months jail sentence.
Dear Editor - I have seen in your paper response by the Chairman of the Parole Board that the release of Mr Luisbaea was within the laws.

As a lawyer, I need more than just that.

The Chairman’s disclosure that Mr Lusibaea was released on licence tells me that the Parole Board did refer to the board’s functions prescribed under section 73(5) of the Act.

But unless “release on licence” is different from “early release”, I am of the view that Mr Lusibaea has been released too early contrary to section 70 of Correctional Service Act 2007.

The Attorney General should apply to the High Court by way of judicial review seeking a declaration on the issue whether section 70 applies to consideration of  an application for  “release on licence” under section 73. If the answer would be in the affirmative, the release of Mr Luisbaea would be unlawful.
