THE hearing of an appeal case in relation to a man who appealed his conviction in the Honiara Magistrates’ Court will be heard in the High Court on Tuesday, next week.
Nicholas Hemu was found guilty of one count of malicious damage after a trial in the Honiara Magistrate’s Court early this year.
This was for damaging the autopsy table inside the morgue at the National Referral Hospital in 2013.
After his verdict, he appealed conviction which resulted in his sentence being upheld awaiting the outcome of the appeal hearing.
The Prosecutions in turn also lodged an appeal.
They are making the cross-appeal to overturn the presiding magistrates’ decision to have suspended the sentence in the Honiara Magistrates’ Court.
Prosecution made appeal hoping that the magistrate delivers the sentence.
The Public Solicitor’s Office represents Hemu while the Office of the Director of Public Prosecutions is appearing for the Crown in the appeal.
