Prosecution is considering withdrawing the unlawful wounding charges against some of the men accused of the armed robbery outside of the Bank of South Pacific (BSP) at Point Cruz earlier this year.
This was due to insufficient evidence found regarding the unlawful wounding charge against four of the five men facing the armed robbery charge.
As a result, prosecution is considering withdrawing this particular charge against Stanley Ramo, Eric Junior Nathaniel, Richard Rurai and Ben Farobo expect for David Faiga.
These five accused were charged with armed robbery and unlawful wounding while two other men Billy Deodore and Milton Gwaliasi were charged with receiving.
These two accused were not part of the armed robbery but were accused of receiving part of the stolen money.
The court also heard yesterday that prosecution is considering withdrawing the receiving charge against Deodore and Gwaliasi.
Mr Kekou asked for more time so that a memo can be rendered to the Director of Public Prosecutions for his consideration.
The matter was listed on the last court hearing for a pre-trial conference on July 18.
Prosecution was however ordered to provide documents for the pre-trial conference before that date.
Mr Kekou said the delay in providing the documents was due to insufficient evidence on some of the charges.
These issues were raised in court yesterday when the matter was brought for the ruling of the bail applications made for Ramo, Faiga and Nathaniel.
Deputy Chief Magistrate Shepherd Lapo however the bail applications and further remanded them to July 18 when all the accused will turn up for the pre-trial conference.
Farobo, Faiga, Ramo, Rurai and Nathaniel were charged in relation to the incident on the morning of 18 January outside of the former Westpac bank, now the BSP.
They allegedly robbed a carton containing $1 million from two Asians who were on their way into the bank to make deposits.
Prosecution alleged that while one of the accused waited in a car parked outside the bank, others went and attacked the complainant and grabbed the carton containing the money.
They allegedly escaped in the car but were shortly arrested, charged and remanded in custody.
Police alleged that the men were all masked and one of them was armed with a knife.
